Capital Gains Tax, if applicable to the sale of your Cyprus property, is payable upon completion of the sale, not as in the UK, at a later date within an annual return.
In order to complete any sale, you, the seller (or your lawyer) are required to produce a 'Tax Clearance Certificate' from the district tax office as evidence that you have either paid any capital gains tax that is due, or that there is none due, and that all service charges, utility bills and immovable property tax have been settled in full.
Capital Gains Tax is charged at 20% of the profit from the sale of your Cyprus property (less certain costs, expenses, improvements, etc). Each individual does have personal allowances, as below.
Sale of a main residence (subject to conditions) is set at €85,430 if you have five years’ residency.
Sale of a 2nd home or investment property is set at €17,086 per owner.
Note: These allowances are given only once in an individual’s lifetime, not per property or per year. However, if you sell a property you may have a credit pending a sale at some time in the future if all your allowance is not used up.
If you are selling a property in Cyprus before the individual or separate title deeds are transferred and registered into your name, it is common practice that you may be charged a ‘cancellation fee’ by the seller (the developer or registered land owner).
A cancellation fee is a form of administration fee for the 'cancellation & re-sale' of your property in Cyprus. Your lawyer will arrange for a 'cancellation agreement' to be signed between you and the developer or registered land owner, simultaneously with a contract of sale signed between the new buyer and the developer or registered land owner. These are submitted to the Land Registry at the same time as the new contract is lodged and means that your right of specific performance is replaced by that of the new buyers.
The amount charged as a cancellation fee can vary, most lawyers accept, or consider that half the amount you would have been charged in transfer fees, to be a reasonable figure. Title deeds upon separation are automatically issued in the name of the beneficial owner, according to the contract of sale lodged for specific performance. Therefore, by selling your property without title deeds, you will not pay the transfer fee, the new owners will, unless the title deeds are available in which case you are obliged to take them before the sale proceeds.
We suggest you obtain a fixed quotation for legal fees/conveyancing when selling your property. It is important to have a solicitor/lawyer/advocate ready to act on your behalf when a purchaser is found. If you are not resident in Cyprus, it is advisable to give your lawyer power of attorney.
When the sale of your property is completed you will need to surrender the keys to the new owner, your estate agent or lawyer. It is good practice to check the property is clean, secure and all fixtures, fittings and contents included in the sale are at the property so that there can be no reprisals or last-minute hitches that hinder the transaction.
You should take the meter readings of the water and electricity and settle your utility accounts.

Upon completion of the sale, you might be transferring funds out of Cyprus and/or converting them into another currency, possibly the currency of your home country.
